1. About this Web document
   1. These are the terms and conditions upon which Real Estate Commercial (referred to as “REC” from hereon) will allow You to advertise commercial real estate for sale or lease or a business for sale
2. 2. Provision of advertising
   1. REC will provide advertising subject to these conditions in return for a flat fee.
   2. It is a condition of advertising that You are the registered owner of the property to sell or lease or the business to sell
3. 3. How to place a listing on the site
   1. A listing must be submitted to REC online through its website
   2. When submitting, amending and/or removing a Listing, You must comply with REC procedures, terms of use, and specifications (as amended from time to time).
   3. Listings must only relate to property currently available for purchase or lease. Within 7 days following a listing being withdrawn from the market, leased or sold, You must remove the listing.
4. 4. Payment
   1. The Flat Fee is due and payable by You at the time a Listing is submitted to the website (or at such other time REC directs).
   2. REC may alter the Fee at any time without notice. Such alteration shall be effective on the date of alteration but will not apply to listings submitted to REC prior to that date.
   3. You must pay all taxes and duties or impost payable in respect of the Advertising.
5. 5. Your other obligations
   1. You must:
      1. ensure the listing only contains details about a property or business and Your contact details;
      2. ensure the Listing is not unlawful or for an improper purpose and does not contain material that is misleading or deceptive, defamatory, breaches any copyright, trade mark or obligation of confidentiality, or that is contrary to privacy legislation or any other applicable law;
   2. You acknowledge:
      1. and agree that by submitting a listing, You grant or have procured for REC a non-exclusive, world-wide, royalty-free licence to use, reproduce and adapt the listing to the extent necessary to provide advertising and promote the website;
      2. REC may from time to time edit, refuse to post or remove any listing (in whole or in part) that it considers objectionable or in violation of these conditions;
      3. REC is not obliged to do the things stated in the preceding subclause and has no responsibility for content posted or transmitted by other users of the website;
      4. You must comply with all reasonable directions of REC in connection with the advertising and Your use of the website.
6. 6. Duration of this agreement
   1. These Conditions commence on the date of acceptance and continue for the term or renewal term unless ended earlier in accordance with these Conditions.
   2. The provisions of these Conditions which by their nature are capable of applying beyond expiration or termination of these Conditions, shall continue.
   3. If You breach these Conditions or for any other reason at REC’s reasonable discretion, REC may immediately suspend or cease providing advertising to You and any Fee You have paid shall be forfeited to REC. Nothing in these Conditions prevents REC from exercising any other lawful right or remedy it has.
7. 7. Liability and indemnity
   1. To the extent permitted by law, REC:
      1. excludes all conditions and warranties implied into these conditions and shall not be liable to You for any consequential, special or indirect loss or damage;
      2. shall not be liable to You for any loss, damage or liability arising from a failure of the World Wide Web or any telecommunications structure or for any delay, error oromission in providing the advertising;
      3. limits its liability for breach of any condition or warranty that cannot lawfully be excluded from these conditions, to (at REC’s option) resupplying the advertising or paying the cost of having the Advertising resupplied; and
      4. limits is liability in respect of any other claim in connection with these conditions whether based in contract, tort (including negligence) or statute, to the amount paid to REC for the advertising.
   2. You agree not to hold REC liable for the accuracy of, public perception of, transactions or inquiries that result from or fail to result from, and/or REC’s failure to publish in the format You request, a Listing published on the website.
   3. You indemnify REC against all claims, liabilities, proceedings, losses, damages, expenses and costs (including legal expenses on a solicitor-client basis) that it suffers or incurs in connection with Your breach of these conditions and /or Your negligent or unlawful act or omission in connection with the advertising.
   4. If REC requires You to make payments by direct debit, cheque or electronic funds transfer, You must indemnify REC for any losses it sustains as a result of use of such payment method unless those losses are caused by the fraud of REC.
8. 8. General
   1. These conditions comprise the entire understanding and agreement between You and REC as to the Advertising.
   2. If any of these conditions is or becomes for any reason invalid or unenforceable at law, the validity and enforceability of the remainder of them shall continue unaffected.
   3. The laws in the State of Queensland, Australia govern these Conditions and You must submit to the exclusive jurisdiction of the Courts of that State.
9. 9. Dictionary
   1. In this document:
   “Acceptance” means the first occurrence of any of the events enumerated in clause 3.3,
   “Advertising” means the process to enable You to upload and have published on the Site, a Listing and also includes any other service/s that may be described in the Particulars from time to time,
   “Conditions” has the meaning given in clause 1.1 and consists of clauses numbered 1 to 9 inclusive and the Particulars,
   “REC” means Real Estate Commercial Pty Ltd
   “Flat Fee” means a non-refundable fee payable for the advertising in accordance with these Conditions.
   “Listing” means all information, details, and materials (including digital images about a Property and any click-through URL provided for access to Your or another web site), submitted by You to REC for publication on the website,
   “Particulars” means the items in the particulars section of this document,
   “Property” means the commercial real estate for sale or lease relating to the Listing,
   “Website” means the World Wide Web site operated by REC under the URL ‘www.realestatecommercial.asia’, and
   “You” or “Your” refers to you as the user of the Advertising and includes your employees, officers, agents and contractors.

 

Particulars

1. Flat Fee: $nominated fee.
2. Term of advertising listing:

1. 90 days for lease property

2. until sold for property or business for sale.
3. Description of advertising to be provided and any other services (if any):
   • Advertiser to upload to the realestatecommercial.com.au real estate website advertising in accordance with our input form including up to 10 images of the subject property or business in jpeg format.
   • Advertiser will be notified be email one week before the listing period expires so that advertiser can renew the listing if desired.
   • The listing will be removed from the realestatecommercial.com.au web site at the expiration of the listing period period if the listing is not renewed.
